The value of Intellectual Property definitely depends on one’s viewpoint. The originator is deeply connected with the IP and its myriad of uses. The licensee needs to see this value and that’s MindForce’s job. Here are a number of ways we can work to unleash this value:
CREATE A UNIVERSITY OR CORPORATE LICENSING PROGRAM
We put together a MindForce Licensing Team focused on finding one or more licensees who are willing to pay royalty fees. We approach technology licensing ONLY from a business and market-focused perspective as most of our project leaders combine the business savvy of seasoned MBAs and considerable technology subject matter expertise.
In all cases, we accept assignments where our success is our client’s success. Usually, we first conduct an initial market analysis to understand the scope of the opportunity, work effort involved and upside. In order to move forward, we then must have a firm belief that we can secure one or more licensees if our client has reasonable expectations. Otherwise, why bother.
Our upside, in all cases, will include an incentive-based back-end success royalty fee for each license we do. We may also ask for a minimal upfront fee to define the specific market opportunity, especially if we need to create the marketing sales package to send to potential licensees.
Then, our team, leveraging their business contacts and MindForce’s network resources, actively seeks out companies to discuss the licensing opportunity. We also can actively help close the licensing sale by assisting in the licensing negotiations.
EVALUATE IP PORTFOLIO TO FIND “MARKET READY” OPPORTUNITIES
MindForce can easily conduct consulting projects where the IP Owner would like to get a market viewpoint about a portfolio of IPs, i.e. each IP’s market commercialization potential. We excel at tapping into Subject Matter Experts (SMEs). We have proven that we can consistently organize these SMEs into short-term consulting teams asked to provide input based on their individual and collective experiences and information provided, i.e. a “Wisdom of Crowds” effect.
 SHOULD WE PATENT THIS IP?
We bring together 3 to 5 industry experts (or more views, if required). They read information about IP provided by client, interview the IP champion(s) at the company or university, and use their industry experiences to individually and collectively assess and recommend the IP’s best potential commercialization outcome. This may be either as a stand-alone start-up, or a licensing play, or IP that should be combined with other IP to maximize value, or IP that has no commercial value.
DOES THIS PATENTED OR PATENT-PENDING IP HAVE BUSINESS VALUE?
Corporations have lots of patents, most of which is sitting on their shelves. Inventors have spent tremendous time, effort and money to secure a patent. Now what? We’ll bring in the right business expert or experts to conduct either a “deep dive” market assessment or a more cursory analysis, depending on the client’s requirements and the perceived potential of the patent IP.
At the end, we’ll give you our view if the IP should be licensed, has enough heft to turn into a product, and should you start a company based on it.
